Two lower courts have already ruled against President Trump's use of emergency powers to impose tariffs.
Costco has filed a lawsuit with the US government, seeking a full refund of import duties if the Supreme Court rejects President Trump's authority to impose tariffs without congressional approval. The company argues that two lower courts have already ruled against Trump's "emergency" tariffs as illegal and is concerned it won't receive refunds even if the Supreme Court upholds these rulings. Costco claims its business has suffered due to the tariffs and estimates that importers like itself have paid around $90 billion in IEEPA-related tariffs. The lawsuit aims to secure a refund before a 15 December deadline, after which it would be difficult for companies to recoup their funds.
