The lawsuit argues the White House exceeded its authority in imposing the latest tariffs on the country and caused "immediate harm to American businesses".
* A new lawsuit has been filed against US President Donald Trump's tariffs on Canadian goods, arguing that the White House exceeded its authority in imposing the levies.
* The Liberty Justice Center, representing US food business Gellert Global Group, is suing to block the 50% tariff on $20bn of Canadian goods, including cheese and dairy products.
* The lawsuit argues that Section 338 of the 1930 Tariff Act, which Trump used to justify the tariffs, does not allow for "sweeping tariffs or import restrictions" without Congressional approval.
* Gellert Global Group is facing both US and Canadian retaliatory tariffs, affecting its business relationships with suppliers and customers in the food industry.
* The Liberty Justice Center has also filed a motion for a preliminary injunction to block collection of the tariffs, citing that Section 338 has been superseded by Section 301 of the Trade Act of 1974.
* This is the fourth case brought by the group against Trump's tariffs, with previous cases resulting in successful challenges to the International Emergency Economic Powers Act (IEEPA) tariffs.
